On order of the Court, the application for leave to appeal is considered and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REVERSE the order of the Court of Appeals and REMAND this case to that Court for plenary consideration of the issue raised in the plaintiff's appeal of right. The trial court's disqualification of the plaintiff's expert witness was, at least in part, based on the requirements of MCL 600.2169; MSA 27A.2169 and MRE 702. The record demonstrates the trial court did not abuse its discretion. The application for leave to appeal as cross-appellant is therefore moot and is DENIED. This order should not be construed as a ruling on the constitutionality of MCL 600.2169; MSA 27A.2169. McDougall v Eliuk, 218 Mich.
